Rep. Schmaltz leads effort to protect seniors and vulnerable adults

‘We need commonsense guidelines for professional guardians’

Michigan’s most vulnerable citizens could soon gain stronger protections thanks to a plan spearheaded by state Rep. Kathy Schmaltz that establishes professional licensing standards for guardians and conservators.

The plan, approved by the House Families and Veterans Committee, ensures that those entrusted with the care of incapacitated adults meet rigorous standards, are properly vetted, and are held accountable for their actions.

“Families should never have to worry that the person responsible for a loved one’s care and finances is unqualified or unvetted,” said Schmaltz, R-Jackson. “This plan will give peace of mind to families and protect Michigan residents from abuse or financial exploitation. It’s about safeguarding our most vulnerable citizens and ensuring they are treated with the dignity and security they deserve. We have to protect our seniors and vulnerable adults.”

House Bills 4727, 4728 and 4729, any professional guardian or conservator serving Michigan residents would be required to:

  • Obtain national certification from the Center for Guardianship Certification, a recognized standard in the field;
  • Submit to a criminal background check conducted by the Michigan State Police; and
  • Apply and obtain a license through the Michigan Department of Licensing and Regulatory Affairs.

The plan also establishes a nine-member oversight board appointed by the governor to monitor the activities of licensed guardians and conservators and provide a venue for families and loved ones to lodge concerns or complaints.

“Too often, guardians and conservators have operated with little oversight or accountability,” Schmaltz said. “This commonsense reform ensures that professionals who hold such critical responsibilities meet strict standards and are answerable for their actions. Michigan residents deserve nothing less.”

House Bills 4727, 4728, and 4729 now advance to the full House of Representatives for further consideration.
